Welcome to MJK Electric LLC. These Terms of Service ("Terms") govern your access to and use of our website, client portal, and electrical services. By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

1. Definitions

  • "Client," "You," or "Your" refers to the individual or entity using our services
  • "Services" refers to electrical contracting services, consulting, and related activities
  • "Portal" refers to our online client access system
  • "Website" refers to mjkelectric.com and related subdomains

2. Services Description

MJK Electric LLC provides industrial and commercial electrical contracting services including, but not limited to:

  • Heavy machinery and equipment installation
  • Complex power system design and implementation
  • Electrical maintenance and repairs
  • Mission-critical infrastructure projects
  • Project consultation and planning
  • Client portal access for project management and communication

3. User Accounts and Portal Access

3.1 Account Registration

To access certain features of our Portal, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.

3.3 Acceptable Use

You agree not to:

  • Use the Portal for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any portion of our systems
  • Upload or transmit viruses, malware, or other harmful code
  • Interfere with or disrupt the integrity or performance of our services
  • Share your login credentials with unauthorized individuals
  • Access or attempt to access data belonging to other clients

4. Email and SMS Communication Terms

4.1 Consent to Electronic Communications

By providing your email address and mobile phone number, you consent to receive electronic communications from us, including emails and SMS/text messages. These communications may include project updates, appointment reminders, billing notifications, safety alerts, and other service-related information.

4.2 Email Communications

You agree that we may send you emails regarding your account, projects, and our services. We implement industry-standard security measures to protect email communications. However, you acknowledge that email transmission is not completely secure, and you assume the risk of interception. Do not send sensitive information via unsecured email.

4.3 SMS/Text Message Terms

By providing your mobile number and opting in, you agree to receive SMS messages from MJK Electric LLC. Message and data rates may apply. Message frequency varies based on your active projects and notification preferences. You may receive:

  • Project status updates and milestone notifications
  • Appointment confirmations and reminders
  • Urgent service alerts and safety notifications
  • Billing and payment confirmations
  • Document signature requests

4.4 Opt-Out and Modifications

Email: You can unsubscribe from marketing emails by clicking the "unsubscribe" link in any marketing email. Transactional emails related to your account or active projects cannot be opted out of while services are ongoing.

SMS: You can opt out of SMS messages at any time by:

  • Replying "STOP" to any SMS message from us
  • Updating your notification preferences in the Client Portal
  • Contacting us directly at 602-930-7277

After opting out, you may receive a confirmation message. Please allow up to 48 hours for your request to be processed. Opting out of SMS does not affect your email preferences or access to services.

4.5 Data Protection for Communications

We are committed to protecting your email and mobile data. Your contact information is stored securely, used only for legitimate business purposes, and never sold or shared with third parties for marketing. For complete details, please review our Privacy Policy.

5. Proposals, Quotes, and Contracts

5.1 Proposals

All proposals provided by MJK Electric LLC are valid for the time period specified in the proposal. Prices are subject to change after the expiration date. Proposals are based on the information provided by the Client and are subject to revision if site conditions differ from the initial assessment.

5.2 Contract Formation

A binding contract is formed when a signed proposal or separate contract document is accepted by MJK Electric LLC. Electronic signatures provided through our Portal are legally binding and equivalent to handwritten signatures.

5.3 Changes and Modifications

Any changes to the scope of work must be documented in a written change order signed by both parties. Verbal change requests will not be honored. The Client is responsible for additional costs resulting from changes, unforeseen conditions, or delays caused by the Client.

6. Payment Terms

6.1 Pricing and Billing

All prices are quoted in U.S. dollars unless otherwise specified. Payment terms are as stated in your contract or proposal. We accept payment via check, ACH transfer, credit card, and other methods as specified in your agreement.

6.2 Late Payments

Late payments may be subject to interest charges at the maximum rate permitted by law and/or collection fees. We reserve the right to suspend work on projects with overdue balances exceeding 30 days.

6.3 Deposits

Certain projects may require a deposit before work begins. Deposit amounts and terms will be specified in your proposal or contract. Deposits are non-refundable once work has commenced.

7. Warranties and Limitations

7.1 Workmanship Warranty

MJK Electric LLC warrants all workmanship for a period specified in your contract (typically one year) from the date of substantial completion. This warranty covers defects in installation and workmanship under normal use and conditions.

7.2 Equipment Warranties

Equipment and materials are covered by the manufacturer's warranty. We will assist in facilitating warranty claims but are not responsible for manufacturer defects or warranty denials.

7.3 Warranty Exclusions

The warranty does not cover:

  • Damage caused by misuse, abuse, or negligence
  • Normal wear and tear
  • Acts of nature or force majeure events
  • Modifications or repairs performed by unauthorized parties
  • Issues arising from pre-existing conditions not disclosed to us

7.4 Disclaimer

EXCEPT AS EXPRESSLY STATED HEREIN, MJK ELECTRIC LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.

8. Insurance and Liability

8.1 Insurance

MJK Electric LLC maintains general liability insurance, workers' compensation insurance, and other appropriate coverage. Certificates of insurance are available upon request.

8.2 Limitation of Liability

IN NO EVENT SHALL MJK ELECTRIC LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF DATA, ARISING OUT OF OR RELATED TO OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.3 Indemnification

You agree to indemnify, defend, and hold harmless MJK Electric LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your breach of these Terms, or your violation of any law or third-party rights.

9. Intellectual Property

All content on our Website, including text, graphics, logos, images, and software, is the property of MJK Electric LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Upon full payment, you receive a non-exclusive license to use project-specific documentation (plans, schematics, reports) for your internal business purposes. This does not transfer ownership of our proprietary designs, processes, or methodologies.

10. Confidentiality

Both parties agree to maintain the confidentiality of proprietary and confidential information disclosed during the course of our business relationship. This includes, but is not limited to, trade secrets, business plans, technical specifications, and client data.

This confidentiality obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

11. Termination

Either party may terminate a service contract in accordance with the termination provisions specified in the applicable proposal or contract. Upon termination, you remain liable for all outstanding payments for services performed and materials procured prior to termination.

We reserve the right to terminate or suspend your Portal access immediately, without prior notice, for any breach of these Terms or for conduct that we determine is harmful to our business or other users.

12. Dispute Resolution

12.1 Governing Law

These Terms and any disputes arising hereunder shall be governed by the laws of the State of Arizona, without regard to conflict of law principles.

12.2 Dispute Resolution Process

Any dispute arising out of or relating to these Terms or our services shall first be addressed through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through mediation or binding arbitration in Maricopa County, Arizona.

12.3 Class Action Waiver

You agree that any proceedings to resolve disputes will be conducted only on an individual basis and not as a class action, consolidated action, or representative action.

13. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, supply chain disruptions, government actions, or natural disasters. In the event of a force majeure, the affected party shall notify the other party promptly and make reasonable efforts to resume performance.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our Website. Your continued use of our services after any changes constitutes acceptance of the revised Terms. Material changes will be communicated via email or through the Portal.

16. Entire Agreement

These Terms, together with any proposal, contract, or other written agreement between you and MJK Electric LLC, constitute the entire agreement between you and us regarding our services and supersede all prior agreements, understandings, and communications.
